Court stays Cabinet decision on Chandrika's land, security

[TamilNet, Tuesday, 21 March 2006, 00:03 GMT]
Sri Lanka's Supreme Court Monday issued an interim order staying the Sri Lanka Cabinet's decision to allocate land in Madiwela and to provide additional security personnel to former Sri Lankan president, Chandrika Kumaratunge, legal sources in Colombo said. The three member bench of the Supreme Court chaired by the Chief Justice Mr.Sarath N. Silva made the interim order after preliminary hearing of a Fundamental Rights application, legal sources said.

Other two members of the bench were Justices Raja Fernando and Gamini Amaratunge, legal sources said.

The FR application filed by three Attorneys-at-Law was taken up for hearing Monday. Mr.Peter Jayasekara, Counsel for the petitioners argued that the Cabinet decision to allocate a land in Madiwela and to provide a 168 member-contingent of Sri Lanka Army to the former president as security is contrary to the law of the land. The petitioners have sought the court to quash the decision of the Cabinet.

The SC issued an order staying the implementation of the Cabinet decision till an inquiry into the FR application is held.

The court issued notice on the respondents Ms Chandrika Kumaratunge and members of the Cabinet to appear in court on 19 July when the petition is to be taken up for further hearing, legal sources said.
