Anandasangaree case goes to Supreme Court

[TamilNet, Friday, 23 April 2004, 16:12 GMT]
Mr.R.Sampanthan and Mr. Joseph Pararajasingham, the Secretary General and the Senior Vice President of the Tamil United Liberation Front (TULF) respectively, Friday filed an application in Sri Lanka’s Supreme Court, seeking an order to suspend the interim injunction issued by the District Court of Colombo preventing them from holding the central working committee or any other meeting of the TULF without the approval of Mr. V.Anandasangaree, President of the party, legal sources said.

Petitioners in their application have said the interim injunction issued by the District Court of Colombo on an application filed Mr.Anandasangaree is not in accordance with the law and it should be suspended immediately enabling them to conduct the business of the party without any interruption, legal sources said.

The Court of Appeal has confirmed the interim injunction of the Colombo District Court against them when the petitioners appealed against it. Hence the petitioners have come before the Supreme Court praying for the relief, petitioners state in the application, legal sources said.

The Supreme Court will fix a date to hear the application in due course, legal sources said.

Mr.Anandasangaree obtained an interim injunction in the Colombo District in October last year when majority members of the TULF central working committee moved a motion of no-confidence against him in a bid to oust him from the party, legal sources said.

Since then, the petitioners have been barred from holding TULF central working committee and other organizational meetings, which resulted in the Tamil National Alliance (TNA) contesting the April 2 poll under the “House" symbol of the Ilankai Thamil Arasu Katchchi, instead of the TULF's "Rising Sun" symbol, sources said.

In the April 2nd poll, Mr.Anandasangaree unsuccessfully contested the Jaffna electoral district fielding an independent group, sources said.

The case filed by Mr.Anandasangaree in the Colombo District Court has been listed for hearing on May 16 for the parties to file written submissions, legal sources said.
